GTA:SA Hot Coffee Brings On More Lawsuits

Take-Two is facing more trouble as two lawsuits have been filed against the publisher on behalf of shareholders.

Milberg Weiss and Stull, Stull & Brody are seeking to file class-action suits due to controversy surrounding Grand Theft Auto: San Andreas. The law firms are seeking shareholders who bought stock in Take-Two between October 25, 2004, when GTA: SA was first shipped, and January 27, 2006, when the company was first sued for the Hot Coffee mod of the game.

Both suits claim that Take-Two did not admit it had hid the Hot Coffee sex mini-game in order to receive a Mature rating from the ESRB. If the game had received an Adults Only rating, sales would have been significantly lower and the company would have reduced its financial guidance. Stull, Stull & Brody aruges that Take-Two “violated federal securities exchange laws by issuing a series of materially false statements regarding the success of the Company’s video game Grand Theft Auto: San Andreas and the strong contribution that it was making to the Company’s overall revenues.”

Milberg Weiss also states that the company “engaged in an undisclosed illegal and fraudulent scheme during the Class Period to bolster sales of the game by including hidden pornographic content.”

Take-Two has not yet commented.
