We reported earlier that the case trying a New Hanover County deputy after the shooting of a suspect in a PlayStation 3 theft case was dismissed. Yet, reports surfaced today that state the case is still open and Christopher Long could still be retried. District Attorney Ben David told North Carolina ’s WCNC that the investigation against the officer is continuing and that a new grand jury convening next month could decide to bring charges against him.

Long’s attorney argued that the court should not retry the case without any new evidence. If the court chooses to retry the case, the attorney argued that Long should be allowed to testify, a privilege he was not granted during the first trial.
