A suit has been filed by Jason Gibson on behalf of Keith Kay, Orlando Perez, and Shannon Smith against the Microsoft Corporation.  This Texas trio of gamers decided to litigate after experiencing major Xbox LIVE downtime issues over the holidays.  According to MTV’s exclusive interview with Gibson, the plaintiffs seek $5 million in damages “for December failures in the online gaming service.”

Attorney Gibson stated to MTV that, “”These are not guys looking to get rich.” Gibson went on to say, “They are in their late 20s and 30s. They are college-educated. These are not young kids who just turned 18 and [want] to sue for the fun of it. This is, to them, a real issue.”

Apparently $5 million divided four ways isn’t a lot of money in Gibson’s eyes.  Microsoft has promised to reimburse gamers for the inconvenience by giving them a free LIVE Arcade game.  This concession was made long before the class-action suit was brought, but this offering was not sufficient for the plaintiffs or the other members of the suit who have jumped on the band wagon.

Look for more expensive LIVE subscriptions and LIVE Arcade games in the future if these jokers are found to be right.
